Data controller

Watchout Tours Ltd., a limited company incorporated in New Zealand, with its address in Picton, New Zealand. Contact: info@watchouttours.nz.

Although we are a New Zealand company, our services are aimed at people resident in Spain and the European Union, so we process your data in accordance with the General Data Protection Regulation (GDPR) and New Zealand's privacy legislation (Privacy Act 2020).

Data we collect

Only what you provide voluntarily through the contact form:

• Name
• Email and/or phone (at least one, so we can reply to you)
• Your preferred channel for us to contact you
• The type of trip you're interested in (optional)
• The content of any message you'd like to write to us (optional)

What we use your data for and on what basis

Purpose: to respond to your enquiry and talk with you about the trip you're interested in. Nothing more. We don't store your data in marketing databases, we don't send advertising or newsletters, and we don't create profiles.

Legal basis: pre-contractual measures taken at your request (Art. 6.1.b GDPR) and your consent, which you give by ticking the acceptance box before submitting the form (Art. 6.1.a GDPR).

How long we keep it

Only for as long as necessary to handle your enquiry and any conversation that arises from it. If you don't end up travelling with us, we delete your data within a maximum of 12 months from the last contact.

Who else processes your data

We don't share your data with third parties. To receive the form messages we use Formspree, Inc. (USA) as a technology provider, acting as a data processor in accordance with its privacy safeguards (opens in a new tab). This international transfer is covered by the applicable EU–US data protection clauses and frameworks.

The rest of the processing takes place in New Zealand, a country with an adequacy decision from the European Commission: the EU recognises that its level of data protection is equivalent to the European one.

Cookies

This website does not use analytics, tracking or advertising cookies. We only use essential local technical storage for the site to work (for example, an anti-spam limit on the form), which is exempt from the consent requirement. That's why you won't see any cookie banner.

Your rights

You have the right of access, rectification, erasure, objection, restriction and portability of your data. You can exercise them by writing to info@watchouttours.nz and we'll reply as soon as possible.

If you believe we haven't handled your data correctly, you can also lodge a complaint with the Spanish Data Protection Agency (www.aepd.es (opens in a new tab)).
